Amgen Australia Privacy Statement

Introduction

Amgen Australia is a leading multi-product biopharmaceutical company supplying products to Australia and New Zealand, supporting Amgen Inc. in the United States. It is involved in the research, development and marketing of biopharmaceuticals and the supply of healthcare materials. Amgen Australia values the relationship it has with its employees, healthcare professionals and their employees and our patients/consumers. We are committed to protecting the personal information that people entrust to us.

This document explains the types of personal information we keep on record and how we may use this information. It also provides some detail about your privacy rights along with our general rights and obligations.

Amgen Australia is bound by the National Privacy 'Principles' contained in the Commonwealth Privacy Act 1988. The Principles are designed to protect the confidentiality of personal information and the privacy of individuals by regulating the way personal information is collected and managed.

In summary, 'personal information' is information or an opinion relating to an individual which can be used to identify that individual such as an individual's name, address, telephone or facsimile number or email address. Personal information may include 'sensitive information'. Some examples of sensitive information include a person's ethnic or racial origin, membership of a professional association or health information such as an individual's medical history.

Personal information collected by Amgen Australia

Amgen Australia collects personal information for many aspects of its activities, including the following:

  1. Healthcare Professionals and their Staff
    Amgen Australia collects personal information about healthcare professionals such as doctors and pharmacists who prescribe and dispense Amgen Australia products so that we can liaise with them. This information may include an individual's contact details, speciality or areas of interest. In most cases, if you do not provide information about yourself, which Amgen Australia has requested, Amgen Australia may not be able to provide you with the relevant service or information required.

    Amgen Australia may collect personal information about the doctors/investigators and staff who assist in conducting clinical trials. Generally, for clinical trial staff, the type of information Amgen Australia collects includes the name, address, telephone details, area of expertise, qualifications, position, including information provided on Curriculum Vitae and Financial Disclosure Forms.
  2. Consumers/Patients
    Amgen Australia does not actively seek personal information from members of the public or patients but may obtain it during business activities both in writing and from telephone inquiries. Generally, the type of information Amgen Australia collects in this situation includes a person's name and contact details and information relating to the inquiry. It may be necessary for us to record this personal information to enable us to meet our legal obligations.
  3. Employees
    The Principles and this Policy do not apply to Amgen Australia's treatment of an employee record, where that treatment is directly related to the current or former employment relationship between Amgen Australia and the individual.

 

Information collected during Clinical Trials

Patients may participate in clinical trials of biopharmaceutical products to further medical research and development. These trials are conducted by hospitals or other institutions, and Amgen Australia provides financial and other support to a number of clinical trials. In the case of these clinical trials, Amgen Australia employees or its contractors may view personal information at the clinical trial site to audit and monitor the trial and to comply with regulatory requirements. Amgen Australia receives de-identified information relating to clinical trial patients from doctors and investigators conducting the clinical trial. Personal information such as the patient's name and address is not collected by Amgen Australia.

 

Disclosure

The Principles generally require Amgen Australia to use and disclose personal information, including sensitive information, only for the primary purpose for which it is collected or for a directly related secondary purpose, unless it is agreed otherwise for specific reasons, such as if the use or disclosure of this information is required by law or to prevent a serious and imminent threat to an individual's life, health or safety.

Use
In general, Amgen Australia uses personal information for the following purposes: 
  1. To maintain a record of medical queries, complaints and adverse event reports relating to the company's products and reporting these to relevant regulatory agencies (eg. the Therapeutic Goods Administration, TGA) as required.
  2. To provide health products or services (including advice) that have been requested.
  3. For administering conferences, symposia, seminars or other similar programs organized by the company.
  4. To involve doctors/investigators (and the people who assist them) in clinical trials in accordance with Good Clinical Practice and regulatory requirements.
  5. To notify you of matters the company may be required by law to notify you of (eg. product recalls).
  6. To manage, plan and record meetings between you and Amgen Australia's sales and marketing staff.
  7. To generate customer lists for the purposes of market research.
 
Disclosure
Amgen Australia may disclose personal information to third parties within or outside of Australia in operating its business and conducting its activities. Some examples of where Amgen Australia may disclose personal information about you to a third party include:

  1. regulatory bodies (eg. TGA) where the company is under a legal obligation to provide your personal information.
  2. third parties engaged by the company to provide services (eg. specialist mailing service companies, conference organisers, marketing or advertising companies), but only in relation to the specific service required.
  3. Generally, third parties receiving personal information from Amgen Australia maintain the same confidentiality and, where appropriate, Amgen Australia takes steps to make sure of this.


Accessing personal information Amgen Australia holds about you

You may seek access to the personal information Amgen Australia holds about you. Please submit access requests in writing to Amgen Australia at the address set out below. Amgen Australia will endeavour to process written requests within a reasonable time. We may charge you the reasonable cost of processing your request. In certain circumstances Amgen Australia is entitled to deny access, for example, in situations where;

  1. providing access would, in the case of health information, pose a serious threat (and in the case of personal information other than health information, a serious and imminent threat) to the life or health of any individual.
  2. providing access would have an unreasonable impact upon the privacy of others.
  3. providing access would reveal the intentions of the organisation in relation to negotiations that would prejudice those negotiations or denying access would be required or authorised by law.

Amgen Australia endeavours to ensure that the personal information it holds is accurate, complete and up-to-date.

Amgen Australia has appointed a Privacy Policy representative to oversee Amgen Australia's management of personal information in accordance with this Policy and the Principles.
